These Terms and Conditions (“Terms”) govern the use of RCS (Rich Communication Services) as a marketing and communication tool by [BOOMERANG DIGITAL LIMITED] (“Company,” “we,” “us,” or “our”) to its customers (“you” or “your”). By receiving or interacting with our RCS messages, you agree to be bound by these Terms. 

1. Consent to Receive RCS Messages: 

a. By providing your mobile phone number to us, you consent to receive RCS messages from us regarding our products, services, promotions, and other relevant information. 

b. Your consent is not a condition of purchasing any goods or services from us. 

c. You acknowledge and agree that standard message and data rates may apply to the RCS messages you receive, depending on your mobile service provider and plan. 

2. Message Content and Purpose: 

a. We will use RCS to send you communications that may include, but are not limited to: – Promotional offers and discounts – Product and service updates – Event invitations and announcements – Customer service and support messages – Information about your account or recent purchases – Surveys and feedback requests 

b. We will make reasonable efforts to ensure that the content of our RCS messages is accurate and not misleading. However, we do not guarantee the accuracy, completeness, or timeliness of any information provided. 

3. Opt-Out and Withdrawal of Consent: 

a. You may withdraw your consent to receive RCS messages from us at any time. 

b. To opt-out, you can reply to any of our RCS messages with keywords such as “STOP,” “UNSUBSCRIBE,” or “OPT-OUT.” 

c. We will process your opt-out request as quickly as possible. Please note that due to technical and administrative reasons, you may receive a few additional messages after your request has been submitted.

4. Data Privacy:

5. Limitations of Liability: 

a. The Company is not liable for any delays, failures, or interruptions in the delivery of RCS messages due to factors beyond our control, including but not limited to network outages, mobile service provider issues, or device limitations. 

b. We shall not be held responsible for any damages or losses arising from your reliance on the information contained in our RCS messages. 

6. Changes to these Terms: 

a. We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website. 

b. Your continued receipt of or interaction with our RCS messages after any such changes constitutes your acceptance of the revised Terms. 

7. Governing Law: 

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in England and Wales
